What is Proposition 65?
Proposition 65, officially known as the California Safe Drinking Water and Toxic Enforcement Act of 1986, is a law that requires businesses to provide warnings to consumers about significant exposures to chemicals that may cause cancer, birth defects, or other reproductive harm. It is not a product safety law but a “right-to-know” law designed to inform consumers about potential exposures.
Proposition 65 applies to any company selling products in California. If a product contains any listed chemical above a certain threshold, a warning must be provided. The Proposition 65 list is maintained by the California Office of Environmental Health Hazard Assessment (OEHHA) and includes over 800 naturally occurring and synthetic chemicals found in everyday items such as cosmetics, food, household products, and even furniture. These warnings are commonly found on various consumer goods as well as in public places like restaurants, hotels, and stores.
